Terms of Purchase & Intellectual Property License Agreement

Please review and acknowledge each term below before completing your order. By checking the boxes, you confirm that you have read, understand, and agree to be bound by these legal terms:

Non-Transferable License & Resale Restrictions: I understand that this license is granted solely to me (or my organization), is non-transferable, and cannot be resold, assigned, leased, or transferred without prior written authorization from Simmulations, LLC.
Facilitator Certification Requirement: I confirm that delivery of The Search for The Lost Dutchman’s Gold Mine (LDGM) requires an active, certified facilitator.
Licensed Capacity Limits: I agree to use the simulation only up to the licensed participant volume/capacity purchased per session. Scaling beyond this volume requires purchasing additional authorized licenses/exercise versions.
Exclusive Territorial Partner Royalties: If delivering a session in or for a region with an exclusive Simmulations Partner, I agree to pay the territorial partner 10% of gross session revenue or $2.50 USD per person (whichever is greater), excluding direct travel expenses and per diems, and to submit an itemized invoice to Simmulations, LLC where permissible.
- As of August 2026, these countries include: Japan, Egypt, Romania, Moldova, Switzerland, Germany, United Arab Emirates, Lebanon, Iraq, Jordan, Saudi Arabia, and Qatar.
Authorized Materials Only: I agree that all replacement pieces, physical game components, and supplementary materials must be purchased exclusively through Simmulations, LLC or its officially listed authorized distributors.
Anti-Duplication & Intellectual Property Protection: I agree not to copy, reproduce, alter, scan, or create derivative works from any physical or digital materials. Unauthorized reproduction or use will result in immediate license forfeiture and legal action.
Governing Law & Jurisdiction: I agree that all legal matters and disputes arising under this agreement fall under the exclusive jurisdiction and authority of the State of South Carolina, USA.
